Terms of Service

1. Agreement to Terms

By accessing or using the Branded Packaging Canada website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms are governed by the laws of Canada and the applicable province in which services are rendered.

2. Services

Branded Packaging Canada provides custom packaging design, printing, and manufacturing services to businesses across Canada. All orders are subject to our production capabilities, material availability, and these terms.

3. Orders and Quotes

All quotes provided are estimates and are valid for 14 days unless otherwise specified. All pricing is in Canadian dollars (CAD). Final pricing may vary based on artwork requirements, material costs, and order specifications. An order is confirmed only after we receive your approval of the final proof and payment terms are agreed upon.

4. Artwork and Design

Customers are responsible for providing print-ready artwork that meets our specifications. We offer free design assistance. You represent that you own or have the rights to use all artwork, logos, images, and content submitted for printing. Bilingual French and English artwork proofing is available upon request.

5. Proofs and Approval

Digital proofs will be provided for approval before production begins. It is your responsibility to carefully review all proofs for errors including spelling, grammar, colour, dimensions, and design. Once you approve a proof, Branded Packaging Canada is not responsible for errors that were present in the approved proof.

6. Payment Terms

All prices are in Canadian dollars (CAD). All payments are due in full prior to production commencement. We accept Visa, Mastercard, and Interac e-Transfer. Approved credit terms may be available for established Canadian businesses.

7. Colour Variation Disclaimer

Due to inherent differences in digital screen displays, printing processes, ink formulations, and substrate materials, minor colour variations between digital proofs and final printed products are normal and acceptable within industry standards. Branded Packaging Canada shall not be liable for colour variations that fall within commercially accepted tolerances. Customers requiring exact colour matching are encouraged to request a physical press proof prior to full production, which may be subject to additional charges.

8. Shipping, Risk of Loss, and Carrier Liability

Standard production time is 10-14 business days after proof approval. Rush orders are available at a 15% surcharge (5-7 business days). Delivery is via Canada Post, Purolator, FedEx Canada, or UPS Canada. Delivery times are estimates and are not guaranteed. Risk of loss or damage transfers to the customer upon handover of the order to the carrier. Branded Packaging Canada is not responsible for lost, stolen, or damaged packages in transit; however, we will provide reasonable assistance in filing claims with the applicable carrier upon request. We are not responsible for delays caused by carriers, weather, customs, or other circumstances beyond our reasonable control.

9. Storage and Post-Delivery Conditions

Branded Packaging Canada assumes no responsibility for the condition of products following delivery. Improper storage conditions — including but not limited to excessive humidity, extreme temperatures, direct sunlight, or exposure to moisture — may adversely affect product quality, structural integrity, and print appearance. The customer assumes full responsibility for ensuring appropriate storage and handling of all delivered products.

10. Design Responsibility

While Branded Packaging Canada offers complimentary design assistance as a courtesy service, the final responsibility for reviewing, verifying, and approving all artwork, content, spelling, grammar, dimensions, colours, and design elements rests solely with the customer. Approval of a digital proof by the customer constitutes acceptance of all elements contained therein. Branded Packaging Canada shall not be liable for errors, omissions, or inaccuracies present in customer-approved artwork or proofs.

11. Force Majeure

Branded Packaging Canada shall not be liable for any delay or failure to perform its obligations under these Terms arising from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, fire, flood, war, civil unrest, governmental actions or regulations, supply chain disruptions, material shortages, labour disputes, or failures of third-party service providers. In such circumstances, Branded Packaging Canada will notify the customer as soon as reasonably practicable and make reasonable efforts to resume performance at the earliest opportunity.

12. Returns and Refunds

Due to the custom nature of our products, all sales are final once production has begun. If you receive defective products or products that do not match the approved proof, please contact us within 7 days of delivery with photographic evidence. We will inspect the issue and, at our discretion, reprint the order or provide a credit for defective items.

13. Limitation of Liability

Branded Packaging Canada liability is limited to the cost of the products ordered. We are not responsible for any indirect, incidental, special, or consequential damages arising from the use of our products or services.

14. Intellectual Property

All content on this website, including text, graphics, logos, and images, is the property of Branded Packaging Canada and is protected by Canadian copyright law. You may not reproduce, distribute, or create derivative works without our written permission.

15. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Canada and the Province of Ontario, without regard to conflict of law principles. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.

16. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services constitutes acceptance of any modified terms.
